What Is Required to Transfer a Property Ownership / Title in New Jersey?
Transferring a property title in New Jersey is a critical step in any real estate transaction. Whether you’re buying, selling, gifting property to a family member, or transferring ownership through an estate, ensuring the title is properly transferred protects everyone involved and helps prevent future legal issues.
Depending on the transaction, New Jersey requires certain supporting documents to accompany the deed for recording. A completed Affidavit of Consideration for Use by Seller (Form RTF-1) is generally required when recording a deed. In many sales, a Gross Income Tax form (GIT/REP) must also be completed to determine whether New Jersey Gross Income Tax withholding applies. Additional tax forms, affidavits, or exemption documentation may also be required depending on the type of transfer. If there is an existing mortgage, transferring title does not automatically remove the loan. In a typical sale, the existing mortgage is paid off as part of the closing process. Certain transfers, such as family transfers or estate transfers, may have different requirements, so it’s important to understand how an existing loan may affect your transaction.
Before settlement, a title search is performed to identify any liens, easements, judgments, unpaid taxes, or other issues that could affect ownership. Purchasing title insurance helps protect buyers and lenders against certain title defects that may not be discovered during the title search, including issues such as recording errors, unknown heirs, fraud, or forgery.
The title transfer process requires a properly prepared deed. The deed must accurately identify the property, the current owner (grantor), and the new owner (grantee). Once signed, the deed must be notarized before it can be recorded.
The final step is recording the deed with the County Clerk or Register’s Office in the county where the property is located. Recording updates the public land records and provides public notice of the transfer, helping establish the new owner’s legal interest in the property.
Because every real estate transaction is unique, title transfers can become more complex when involving estates, divorces, trusts, or business entities. Working with an experienced title company helps ensure that all required documents are prepared correctly, deadlines are met, and the transfer complies with New Jersey laws.
